Can the mk3s be upgraded to use a touch sensor instead of the pinda
live z is killing me.
i get a successful print, then print again and if wont stick and requires new z settings

They offer multiple upgrade options--check out their website. However, for most people they don't make sense price wise. You're better off buying a new Mk4 and selling your Mk3S.
Having said that, the new sensor is not a panacea. In fact, there are times I fondly remember my Mk3s (I actually kept one). When the "always perfect" first layer works, it's magic. But it doesn't always. In particular, with the textured sheet I found I have to manually adjust live z when the print starts to get good adhesion, which feels like a step back from the Mk3, where once live z was set I could just start a print and walk away.
Your live z not sticking is certainly not normal. I'd first check to make sure the PINDA is safe and secure in its holder. I had cases of drifting live Z, and they got fixed by a turn of the screw that holds the PINDA in place. Or it could be a broken sensor.
